Breakdown between partners or shareholders in a business relationship can be as distressing for those involved as the break down of a marriage. We have assisted in clients extricating themselves not only from their day to day working arrangements, but also other jointly held investments often by finding leverage for our client in forensic analysis not only of our client's interests but also of other parties that are involved in the transactions.
We have acted for a number of clients in the service industries, including mid tier accounting and legal firms in the separation of their professional and business affairs.
We also acted a number of times in the separation of joint ventures especially in the property, manufacturing and retail sectors.
Mediation
The focus of B2B is to assist with and find successful outcomes for clients who find themselves involved in disputes, predominantly through alternative dispute mechanisms. B2B believes that the success or otherwise in these situation relies heavily on knowing your clients and the opponent's strengths but more importantly their weaknesses and using reputation or commercial pressure in order to exploit these to result in the best outcome for our client.
We assisted a major private company in intense negotiations with a top 20 public company in the retail industry, in respect of our client's existing and future arrangements. We orchestrated our clients' negotiating tactics including scripting our client's responses without the need for litigation.
Litigation
General litigation in areas including the break down of business and financial relationships, intellectual property, trade practices, commercial property and franchising.
We acted in litigation and settlement of a dispute relating to ownership of one of Australia's leading wine makers, including as part of the settlement sale of part of the operations to a major European wine company.
We acted in a dispute for the control of a series of trusts that owned significant real estate and other assets by dealing with the separate rights and responsibilities of Trustees, appointors and beneficiaries, by bringing an action for the replacement of a corporate trustee and appointment of an independent insolvency agent or trustee.
